ENFORCEMENT

  • Violation of a 50C order is a Class A1 misdemeanor — up to 150 days in jail
  • Law enforcement has immediate authority to arrest for a violation
  • Order must be entered into the NCAWARE statewide database
  • Order is enforceable in all NC counties and all 50 states (VAWA Full Faith and Credit)
  • If violated, file CV-626 (Violation Complaint) →

FIREARMS SURRENDER

  • Court may order respondent to surrender all firearms and ammunition (G.S. 50C-5(a)(6))
  • Surrender is to the sheriff of the county of respondent's residence
  • Violation of firearms provision is a separate Class A1 misdemeanor
