Both parents consent to the name change, OR one parent's parental rights have been terminated / the other parent is deceased, OR service was appropriately excused by the Court. If the child is 12 or older: the child has given written consent to the name change, OR the Court finds the name change is in the child's best interest despite the child's objection. Publication was not required for this minor name change, or any applicable publication requirement has been satisfied. The requested name change is not sought for any fraudulent or unlawful purpose. The child is a resident of this county and of the State of North Carolina.

Fill in this form before the hearing as a proposed order
Bring it to court — the judge or Clerk fills in findings and signs
Ask for certified copies immediately after the order is signed (Clerk charges a fee per copy)
Get at least 3–4 certified copies for Vital Records, school, SS Administration, and passport

AFTER THE MINOR NAME CHANGE ORDER

1. Birth Certificate — NC Vital Records (DHHS), bring certified order. This is the most important update for a minor.
2. School Records — bring certified copy to the school registrar
3. Social Security Card — SSA.gov, free
4. Passport — DS-11 if first passport; DS-82 for renewal
Note: Divorce decree that restores a mother's maiden name is a different process — check the divorce decree language, not this form
