DOMESTIC VIOLENCE PRESENT?

If there is active domestic violence, a DVPO (50B) may provide faster protection. This motion is appropriate when existing custody orders need modification for safety.

WHAT THE COURT CONSIDERS

  • Whether there is a credible threat to the child's safety or wellbeing during unsupervised visitation
  • The severity and recency of the conduct alleged
  • Whether the non-custodial parent has taken steps to address the underlying issue (e.g., substance abuse treatment, counseling)
  • The child's own expressed concerns or fears
  • The availability and cost of appropriate supervision
  • The non-custodial parent's visitation history and relationship with the child

SUPERVISED VISITATION RESOURCES

  • NC Council for Women and Youth Involvement maintains a list of domestic violence resources by county
  • The court may appoint a Guardian ad Litem (GAL) to represent the child's interests if safety is seriously in question
  • Supervised visitation is generally viewed as temporary — courts typically set conditions for resuming unsupervised visits
