PURPOSE OF THIS FORM

  • This notice TRIGGERS the debtor's 20-day window to file a Claim of Exemption (AOC-CV-421)
  • Must be served on the debtor at the time of levy or immediately after
  • If not served, the debtor's right to claim exemptions may remain open indefinitely
  • Serve by personal delivery or certified mail with return receipt

NC EXEMPTION AMOUNTS (2023)

  • Homestead (primary residence): $35,000
  • Motor vehicle: $3,500
  • Personal property (household goods, clothing): $5,000
  • Wildcard (unused homestead balance): $5,000
  • Retirement accounts (ERISA/IRA): generally unlimited
  • Social Security, disability, workers' comp: statutory exemptions
  • Married couples may double real property and personal property exemptions
