FILING NOTES
- File with the Clerk of Court in the county where judgment was entered
- The Clerk signs and delivers the writ to the Sheriff
- Sheriff's fee must accompany the writ (county-specific — verify with Sheriff)
- Also serve AOC-CV-422 (Notice of Right to Claim Exemptions) on the debtor
- Debtor has 20 days to file AOC-CV-421 after receiving CV-422
- Writ returnable within 90 days of issuance
EXEMPTIONS APPLY
- Homestead: up to $35,000 in real property (G.S. 1C-1601(a)(1))
- Personal property: up to $5,000 (G.S. 1C-1601(a)(3))
- Motor vehicle: up to $3,500 (G.S. 1C-1601(a)(2))
- ERISA retirement accounts and IRAs are generally exempt
- Social Security, disability, and workers' comp benefits are exempt
- Married couples may double homestead and personal property exemptions
JUDGMENT RENEWAL
- NC judgments expire 10 years from entry (G.S. 1-47(1))
- May be renewed for another 10 years before expiration
- File a new action on the judgment or obtain an extension order
- Post-judgment interest accrues at 8% per annum unless otherwise specified (G.S. 24-5)
