WHAT IS IN FORMA PAUPERIS?

  • "In forma pauperis" means "in the manner of a pauper" — it allows the court to waive filing fees for those who cannot afford them
  • Authorized under G.S. 1-110 for civil cases and appeals
  • You must swear under oath that the financial information is true — perjury applies
  • The Clerk of Court has discretion to grant or deny the waiver
  • If granted, you may also be entitled to free service of process

INCOME THRESHOLD GUIDANCE

  • NC courts generally look to 125% of the Federal Poverty Level as a guideline
  • 2025 FPL (48 states): $15,650/yr individual; add ~$5,380 per additional person
  • 125% FPL (1 person): ~$19,563/yr (~$1,630/mo)
  • The Clerk considers income, assets, expenses, and dependents together — not income alone
  • You may qualify even above the threshold if expenses leave you unable to pay
