OPC LEGAL REQUIREMENTS

  • Mental illness must be established
  • Must be dangerous or at risk of deterioration
  • History of non-compliance with treatment
  • Outpatient treatment must be available and identified
  • A hearing is required — respondent has right to counsel

WHAT HAPPENS AFTER FILING

  • Hearing required before OPC order can be entered

  • OPC order lasts up to 90 days, renewable
