WHEN CAN YOU CLOSE THE ESTATE

  • All debts of the decedent have been paid or otherwise resolved
  • All federal and state taxes filed and paid (or bond posted)
  • Creditor claim period has expired — 90 days from first publication
  • All estate assets have been distributed to heirs or devisees
  • Any real property has been conveyed by executor's deed and recorded
  • Final account approved by the Clerk of Superior Court

AFTER THE CLERK APPROVES

  • Clerk issues a formal Order and Judgment closing the estate
  • Executor/Administrator is discharged from further liability
  • Surety (if any bond was posted) is released
  • Keep all estate records for at least 3 years after closing
  • Executor is personally liable for distributions to wrong parties
