FILING INSTRUCTIONS

  • File at the Clerk of Superior Court in the county where decedent last resided
  • Filing fee: $120.00 (G.S. 7A-307)
  • Bring the original Will (if testate) — do not file a copy
  • Bring decedent's death certificate (certified copy)
  • Bring photo ID for the executor/administrator
  • Letters issue same day in most NC counties

TESTATE vs. INTESTATE

  • Testate — decedent left a valid Will; executor named in Will applies for Letters Testamentary
  • Intestate — no Will; heirs or interested parties apply for Letters of Administration
  • NC intestate succession order set by G.S. 29-14 through 29-21
