FILING INSTRUCTIONS
- File at the Clerk of Superior Court in the county where decedent last resided
- Filing fee: $120.00 (G.S. 7A-307)
- Bring the original Will (if testate) — do not file a copy
- Bring decedent's death certificate (certified copy)
- Bring photo ID for the executor/administrator
- Letters issue same day in most NC counties
TESTATE vs. INTESTATE
- Testate — decedent left a valid Will; executor named in Will applies for Letters Testamentary
- Intestate — no Will; heirs or interested parties apply for Letters of Administration
- NC intestate succession order set by G.S. 29-14 through 29-21
