MODIFICATION RULES — CHILD SUPPORT

  • NC uses the Income Shares Model — both parents' incomes are combined to determine the support obligation
  • 3-Year Rule: If 3+ years have passed since the last order AND the guidelines amount differs by 15%+, that alone constitutes a substantial change — no other showing required
  • A parent's income changing by more than 15% is a substantial change of circumstances
  • Arrearages cannot be modified retroactively — once due and unpaid, support cannot be reduced or forgiven except by the party owed
  • File in the original county where the order was entered (unless jurisdiction has changed)
