The legal description must be sufficient to identify the property. Obtain from the deed, a plat, or the county GIS. Do not rely solely on a street address.

05 CONTRACT INFORMATION
120-DAY DEADLINE: This lien must be filed within 120 days of the last date of furnishing labor or materials. Missing this deadline permanently extinguishes the lien (G.S. 44A-12).

MECHANICS LIEN RULES

  • File with Register of Deeds in the county where the property is located.
  • 120-day deadline from last date of furnishing — NO exceptions.
  • Must be filed before or during the Project within the 120-day window.
  • Serve a copy on the property owner by certified mail (G.S. 44A-11).
  • Suit to enforce the lien must be filed within 180 days of the last furnishing date.
  • Subcontractors/suppliers must also serve a Notice to Owner (G.S. 44A-11.1).
