NC LIEN WAIVER — KEY RULES

  • A lien waiver under G.S. 44A-12 releases the lienor's claim of lien on real property and should be filed with the county Register of Deeds — NOT in the courthouse
  • Full waiver: releases all claims for the entire project; unconditional upon signing
  • Partial waiver: releases lien for work through a stated draw or date; does not release remaining balance
  • Conditional waiver: effective only when specified payment clears; used to exchange for a check before it clears
  • Notarization is required — sign in front of a licensed NC notary
  • Lien waiver is NOT the same as a lien cancellation/discharge — discharge is filed by the clerk after satisfaction
  • 120-day window to file original lien runs from last date of furnishing — act early
