G.S. 44-49 LIEN RULES

  • Under G.S. 44-49, hospitals have an automatic lien on any personal injury settlement for unpaid treatment
  • Must be filed in county clerk's office AND served on all parties
  • Lien attaches to settlement proceeds, not the lawsuit itself
  • Attorney must protect the lien in any settlement
  • Medicare/Medicaid liens (federal) take priority and cannot be waived without CMS approval
  • G.S. 44-50 requires reasonable reduction proportionate to attorney's fees
  • Attorney who settles without satisfying lien is personally liable
  • Always request lien balance before finalizing settlement
