- Under G.S. 44-49, hospitals have an automatic lien on any personal injury settlement for unpaid treatment
- Must be filed in county clerk's office AND served on all parties
- Lien attaches to settlement proceeds, not the lawsuit itself
- Attorney must protect the lien in any settlement
- Medicare/Medicaid liens (federal) take priority and cannot be waived without CMS approval
- G.S. 44-50 requires reasonable reduction proportionate to attorney's fees
- Attorney who settles without satisfying lien is personally liable
- Always request lien balance before finalizing settlement
