INTERPLEADER — KEY RULES

  • Rule 22 NCRCP allows a stakeholder to bring a single action and compel all claimants to litigate their claims in one proceeding
  • G.S. 1-363 authorizes deposit of disputed property with the clerk pending resolution
  • Stakeholder need not admit liability to any claimant — interpleader is appropriate whenever the stakeholder faces multiple inconsistent claims
  • File in Superior Court when amount exceeds $25,000; District Court otherwise
  • Upon deposit and discharge, the stakeholder is typically awarded costs and reasonable attorney fees from the fund
  • Service on all defendants is required; out-of-state claimants may require long-arm service under G.S. 1-75.4
