NC DHHS requires a letter from a licensed physician certifying appropriate clinical treatment for gender transition. No specific surgery is required — clinical treatment is sufficient. The letter must be on physician letterhead.

NC DHHS REQUIREMENTS

  • Physician letter required certifying clinical treatment for gender transition — no surgery required
  • Name change on birth certificate requires a separate court order (SP-86 → SP-87) if not already obtained
  • Submit completed petition + physician letter + $24 fee to: NC DHHS Vital Records, 1903 Mail Service Center, Raleigh NC 27699-1903
  • Processing time: 4–8 weeks from receipt
  • Updated birth certificate issued — old certificate is superseded
  • "X" (non-binary) gender marker available under 10A NCAC 41A .0205

FEDERAL PASSPORT PROCESS

  • Use Form DS-11 (new passport) or DS-82 (renewal)
  • Submit physician letter — no surgery required for passport gender marker change
  • No NC birth certificate correction required first — can be done independently
  • Gender marker "X" available on US passports since 2022
