Deed of Release / Satisfaction of Judgment

G.S. 1-239 · When a judgment has been fully or partially satisfied, the judgment creditor must provide a certificate of satisfaction. This form generates a Deed of Release and Satisfaction of Judgment ready for filing with the Clerk of Superior Court and recording at the Register of Deeds. Requires notarization.

Under G.S. 1-239, the satisfaction must be filed with the Clerk of Superior Court where the judgment was docketed. If real property was affected, also record with the Register of Deeds.

G.S. 1-239 — KEY RULES

  • Upon satisfaction of a judgment, the judgment creditor is REQUIRED under G.S. 1-239 to provide a written certificate of satisfaction upon request — failure is punishable by damages
  • File with the Clerk of Superior Court where the judgment was docketed — the Clerk marks it "Satisfied" in the judgment docket
  • If the judgment was cross-indexed in other counties, file a satisfaction in each county where it was docketed
  • If the judgment attached to real property, also record the satisfaction with the Register of Deeds in each county where the property is located
  • Notarization is required for the satisfaction to be recorded with the Register of Deeds
  • Do not release the judgment until the check clears — conditional language is appropriate in settlement closings
