RULE 60(a) — WHAT YOU NEED TO KNOW

  • Rule 60(a) corrects clerical mistakes — typos, transcription errors, arithmetic mistakes — NOT changes to what the judge actually decided
  • Corrections relate back to the original order date ("nunc pro tunc")
  • If the alleged error reflects what the court actually decided but the result was wrong — you need a Rule 59 motion or appeal, not Rule 60(a)
  • Typically resolved quickly — often ex parte or on consent without a hearing
  • Bring the original order and proposed corrected version to any hearing
