AFTER THE ORDER IS SIGNED

  • Take the signed Order to the Clerk's office for docketing — this creates a judgment lien on NC real property
  • Record an abstract of judgment in each county where defendant owns real property
  • To enforce: use Writ of Execution (to seize personal property) or Writ of Garnishment (to intercept wages or accounts)
  • Judgment is valid for 10 years and may be renewed before expiration
  • Defendant can move to set aside under Rule 60(b) for excusable neglect or other grounds — act promptly on enforcement

POST-JUDGMENT INTEREST

  • Interest accrues at 8% per annum from the date of judgment (G.S. 24-1)
  • Interest accrues until the judgment is fully satisfied
  • Calculate accrued interest when seeking payment: (Total Judgment × 0.08 × Days/365)

ENFORCEMENT TOOLS

  • Writ of Execution — directs Sheriff to seize and sell defendant's non-exempt property
  • Writ of Garnishment — intercepts wages, bank accounts, or debts owed to defendant
  • Judgment Lien — clouds title on defendant's real property until paid
  • NC has debtor exemptions — homestead, vehicle, and personal property cannot be seized up to statutory limits
