INTERMEDIATE PUNISHMENT — KEY RULES

  • Intermediate punishment = probation with at least one residential or intensive condition — more restrictive than community punishment
  • EMS (electronic monitoring) = ankle bracelet worn at all times — cost charged to defendant
  • Day reporting center = report daily for programming, drug testing, and supervision
  • Intensive probation = multiple PO contacts per week, including unannounced home visits
  • If revoked, the presumptive sentence is activation of the suspended sentence (active jail or prison time)
  • Technical violation (missed payment, curfew breach) = court may impose 90-day CRV (Confinement in Response to Violation) before full revocation
  • Keep all documentation of compliance: receipts, program sign-in sheets, employer letters
  • Do not remove, tamper with, or disable any monitoring device — that is an independent criminal offense
