COMMUNITY PUNISHMENT — KNOW THE RULES

  • Community punishment = probation supervised or unsupervised; no active jail time if compliant
  • Violation of ANY condition — including technical ones — can result in a probation violation hearing
  • A new criminal charge is an automatic violation of probation regardless of outcome
  • Drug testing is random and without advance notice; refusal is treated as a positive test
  • The PO has authority to search person, vehicle, and home without a warrant at any time
  • The $40/month supervision fee must be paid; missed payments constitute a violation
  • If given the 24-hour reporting condition, defendant must call PO within 24 hours of any arrest anywhere in the United States
  • Failure to report to PO as directed can be charged as absconding — grounds for immediate revocation
