  • Class H or I felony — 1 point each
  • Class A1 misdemeanor — 1 point
  • Class 1 misdemeanor — 1 point
  • Class 2 or 3 misdemeanor — 0 points

KEY RULES

  • Burden of proof is on the State to prove prior convictions by preponderance
  • Out-of-state convictions default to Class I felony / Class 1 misdemeanor unless DA proves higher equivalency (G.S. 15A-1340.14(e))
  • Only one point added if all prior convictions are Class A1 or 1 misdemeanors (G.S. 15A-1340.14(b)(6))
  • Defendant may stipulate to prior record — stipulation is conclusive
  • Out-of-state juvenile adjudications may count if would be felony in NC
