KEY RULES
- Burden of proof is on the State to prove prior convictions by preponderance
- Out-of-state convictions default to Class I felony / Class 1 misdemeanor unless DA proves higher equivalency (G.S. 15A-1340.14(e))
- Only one point added if all prior convictions are Class A1 or 1 misdemeanors (G.S. 15A-1340.14(b)(6))
- Defendant may stipulate to prior record — stipulation is conclusive
- Out-of-state juvenile adjudications may count if would be felony in NC
