LEAST RESTRICTIVE RELEASE

  • Written promise = no money posted; defendant signs to appear
  • Unsecured bond = amount stated but not posted; owed if FTA
  • Appropriate for first offenses, misdemeanors, strong community ties
  • No prior FTA history strongly supports this release type
  • Magistrate sets at initial appearance; judge can modify anytime

IF DEFENDANT FAILS TO APPEAR
  • Written promise: FTA order issued; arrest warrant follows
  • Unsecured bond: defendant liable for stated bond amount
  • No money was posted, so no cash forfeiture — but civil judgment possible
  • Defendant receives copy of all conditions at signing

CONDITIONS MUST BE SPECIFIC

  • All conditions must be specifically listed on the order
  • Vague conditions are unenforceable in NC courts
  • Defendant must receive a copy of the signed order
  • Magistrate or judge must explain conditions to defendant
  • Travel restrictions must specify counties or states affected
