RELEASE TYPE HIERARCHY
- 1. Written Promise — least restrictive; preferred when appropriate
- 2. Unsecured Bond — defendant liable only upon FTA; no payment required upfront
- 3. Secured Bond — payment required; highest restriction
- 4. Custody Release — released into custody of named third party
- Least restrictive means must be used (G.S. 15A-534(b))
CONSEQUENCES OF VIOLATION
- Willful violation is a Class A1 misdemeanor (G.S. 15A-543)
- Court may revoke pretrial release
- Secured bond may be forfeited (G.S. 15A-544.1)
- New criminal charges may be filed separately
- Failure to appear triggers bond forfeiture process
PRETRIAL SUPERVISION
- Pretrial services available in most NC judicial districts
- Supervision includes check-ins, drug testing, monitoring
- Report any address change to pretrial services officer
- Electronic monitoring may include GPS ankle bracelet
